Alabama has recently seen efforts to revolutionise its gambling industry. However, these attempts are likely to fall short. Senator Greg Albritton, R-Atmore, is spearheading the expansion initiative, and details of his gaming bill emerged on Thursday.

Through his legislation, Albritton advocates for a state lottery, electronic gambling at former greyhound tracks and other venues, regulated sports betting, and a provision that would enable the Poarch Band of Creek Indians to establish four casinos in the Yellowhammer State.

Alabama is one of the few states without a state-run lottery or widespread gambling options. This is surprising, given that neighbouring states have already implemented measures to regulate gaming.

Due to the lack of legal options, local residents have often travelled to other states like Georgia or Mississippi to gamble. This has caused Alabama to miss out on the revenue that could have been generated from legal gambling. Now, considering the current economic pressures, Albritton has decided to make another push.

Shedding Light on the Legislation

On Thursday, Albritton shared that his legislation still required 21 votes to pass in the 34-member Senate. However, he finally revealed details about what the bill entails.

It’s important to note that the senator’s two-bill package also includes a constitutional amendment, which would require approval in a referendum on September 16, 2025, along with a 141-page bill detailing the gambling expansion plans.

Sen. Albritton remarked that the primary reason for his legislation is that gambling in Alabama is currently unregulated and requires oversight. He also pointed out that the state’s coffers need revenue during economic struggles and less funding from the federal government.

“If there is anything that is a problem, the biggest problem we have with gambling in society is sports gambling. It’s affecting and afflicting; just look at the Sweet 16. We had sports gambling in that hallway before the Super Bowl. It’s occurring in junior highs. It’s eating us up. If we don’t get control of it, we’ll be in serious trouble.”

What Albritton’s Legislation Proposes

It was finally revealed what Albritton’s legislation would change if enacted. Here are its proposals:

• A state lottery that would be overseen by a public lottery corporation.
• Electronic gambling at six locations: former greyhound tracks in Jefferson, Macon, and Mobile counties and one at the current bingo hall in Greene, Houston, and Lowndes counties.
• Sports betting expansion.
• A 24% tax rate on the net proceeds from electronic gaming and sports betting, an excise tax on each gambling machine, and a sports wagering tax on each bet.
• The governor to negotiate a compact, or a revenue-sharing agreement, with the Poarch Band of Creek Indians. Also, the governor would have the ability to agree on Class III gaming or full-scale casinos with live table games at the tribe’s three electronic bingo casinos in Atmore, Montgomery, and Wetumpka, along with the tribe’s new Birmingham Race Course and Casino.
• An establishment of an Alabama Gaming Commission, which would be responsible for licensing, taxing, and regulating gambling activities in the state. The new agency would also have its own law enforcement division.
• Repeal of 17 local constitutional amendments permitting bingo in specific counties while prohibiting any other local amendments related to gambling.
• Regulations for raffles and traditional paper bingo.

A Scaled-Back Plan

Additionally, the senator admitted that his plan for a gambling expansion is a “scaled-back” version of a comprehensive plan from last year. The said legislation passed the Alabama House. However, it did not find the required support in the Senate and fell short.

It is worth noting that a compromised version of last year’s gambling expansion plan was also launched. However, it ultimately failed as a single vote was not enough to pass in the Senate.

This week, Albritton commented that his bill is a “very trimmed down” variant of last year’s gambling plan. He also said, “It’s the least amount we can do that I think is economically viable.”

Albritton, the chairman of the Senate’s General Fund Budget Committee, shared that the state could benefit from the revenue generated by the proposed gaming plan.

He noted that it is always advantageous for the state to have funding alternatives, as the future is often uncertain. Lastly, he claimed that the federal money is getting thinner and the economy is currently questionable.

Skepticism and Opposition from Senate Leadership

However, Senate President Pro Tem Garlan Gudger, R-Cullman, believes that Albritton’s legislation is doomed to fail because it did not have enough support or time.

Opposition has also emerged from conservative Senators who are concerned about the social and economic impacts of legal gambling. They argue that the proposed expansion of gambling could exacerbate addictions or even lead to increased crime in the state.

Still, others support the initiative. For instance, Senator Del Marsh appeared to back the plan but stated, “We need to get this accomplished in the next week.” He also highlighted the complexity of the topic but believes that gambling should be regulated in the state.

Overall, it remains uncertain whether Albritton’s bill will gather enough momentum to pass in the Senate, given the limited time and significant opposition.
